Acknowledgement and Acceptance of Terms of Service
 
The FAN AREA of the Official Sarah Brightman Forums is the gateway to various member-accessible features including exclusive photo diaries, Forums and a Photo Board.
 
The FAN AREA is privately-owned and is a free courtesy service to registered Members of the FAN AREA, provided that they agree to abide by the following terms and conditions.
 
BY REGISTERING FOR THE FAN AREA, YOU ARE INDICATING YOUR AGREEMENT TO BE BOUND BY ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT ENTER THE FAN AREA.
 
Member Conduct
 
Member agrees to abide by the following rules of conduct while using the FAN AREA:
 
1. Member agrees that all content including photos, information and messages contained within the FAN AREA are for registered members only. Sharing, publishing, distributing, displaying, quoting or linking to ANY FAN AREA content is strictly prohibited.
 
2. Member acknowledges that the FAN AREA constitutes "private property". Free speech, as protected by the First Amendment, does not extend to private property and the owner/administrators/moderators have the right to regulate conduct in the Forums and Photo Board.
 
3. If Member chooses to use the Forums and/or Photo Board, he/she agrees not to transmit any message, information, data, text or other material that is unlawful, vulgar, obscene, harmful, threatening, abusive, harassing, tortious, defamatory, libelous, hateful, racist or bigoted. Conduct that constitutes a nuisance, or that may be invasive of another's privacy, or is otherwise objectionable, will not be permitted. Discussions on politics, sexual orientation, and religion are NOT permitted due to the inflammatory nature of these topics.
 
4. Member will not impersonate any person or entity on the Forums and/or Photo Board or in any communications with the administrators/moderators. Member who creates multiple usernames for the purpose of creating confusion and misrepresentation on the site will be banned.
 
5. Member agrees not to post or transmit any unsolicited advertising, promotional material, "junk mail", "spam", "chain letters", "pyramid schemes", or any other form of solicitation in the Forums and/or Photo Board.
 
6. Member shall not intentionally or unintentionally violate any applicable local, state, national or international law. Member shall not infringe on any patent, trademark, trade secret, copyright or other proprietary rights of any party. Member is solely responsible for the contents that he/she posts on the Forums and/or Photo Board.
 
7. Member acknowledges that the owner/administrators/moderators shall have the right, but not the responsibility, to edit or remove any message posted on the Forums and/or Photo Board. The owner/administrators/moderators shall also have the right to immediately and permanently revoke all membership privileges due to conduct (one-time or cumulative) that is deemed, in their sole discretion, to be objectionable.
 
Statement of General Liability
 
Member is entirely responsible for all information and messages that he/she posts on the Forums and/or Photo Board.
 
Member is hereby strongly advised against disclosing any personal information, whether such information is publicly posted on the Forums and/or Photo Board, or privately disclosed to online acquaintances. Personal information includes, but is not limited to, names, city of residence, addresses, phone numbers, birthdays, photos, workplace details, etc. Member is also strongly cautioned against forming personal and/or intimate relationships — both online and offline — with other Members.
 
If Member chooses to engage in such risky activities, despite the well-publicized potential presence of internet predators and identity thieves, he/she is doing so solely at his/her own risk. Under no circumstances will the owner/administrators/moderators be liable for any ensuing consequences, losses, damages, dangers or crimes.
 
The owner/administrators/moderators do not prescreen or monitor all information or messages. As we have the right, but not the responsibility, to remove messages, Member may inadvertently be exposed to content that is illegal, predatory, offensive, indecent or objectionable.
 
Member acknowledges and agrees that the owner/administrators/moderators neither endorse the messages of any Member communications nor assume responsibility for any illegal, threatening, libelous, obscene, harassing or offensive material contained therein, any infringement of third party intellectual property rights arising therefrom, or any crime facilitated thereby.

Please cut and paste the relevant content into the form and specify the title of the topic and the offending member's username. We do not collect any personally-identifiable information from visitors to the publicly-accessible area of the site.

Store

Any personal and financial information that you provide at the STORE will be disclosed, as necessary, to those parties involved in the processing and fulfillment of your orders.

Fan Area

Users who wish to gain access into the members-only FAN AREA are required to register. We realize that privacy is an important issue and are intent on safeguarding it. We only collect information from our Members on a voluntary basis and do not sell personally-identifiable information to third parties. The Forum software uses cookies to store information on YOUR local computer. These cookies do not contain any registration information you have provided; they serve only to track your user preferences and enhance your experience within the Forums.

Your email address is used for confirming your registration details and password (and for sending new passwords should you forget your current one).

One of the benefits of becoming a Member of the FAN AREA is to receive exclusive offers, invitations and advance notices of events. If you select the option to receive such mailings, your contact information will be used for the purposes of communicating with you. If you elect to enter contests, pertinent information may also be provided to sponsors of contests.

You agree to any information you have provided to being stored in a database. The owner/administrators/moderators cannot be held responsible for any hacking attempts that may lead to the data being compromised.

We always retain the right to disclose any information, as necessary, to comply with any legal, regulatory or governmental request or to protect the rights, safety and well-being of our organization and our community of users and Members.

A Special Note About the Children's Online Privacy Protection Act (COPPA):
 
CHILDREN UNDER THE AGE OF 13 ARE NOT ALLOWED TO REGISTER AS MEMBERS OF THE FAN AREA. In accordance with the provisions of the Children's Online Privacy Protection Act (COPPA), we will not knowingly collect personally-identifiable information from children under the age of 13. Children of all ages are still welcome to enjoy the features of the publicly-accessible areas of the website. We recognize the importance of keeping children safe on the internet and encourage parents to monitor and participate in their children's online activities.
